Notice of Decision on Scope of Environmental Impact Report
For Project at 959 Powell/8Wetmore Streets

Notice is hereby given that the Board of Permit Appeals has conducted a public hearing for the purpose of determining the scope of an Environmental Impact Report (EIR) as required by the Superior Court, Case No. 908-819. The hearing was held on June 5, 1991 between 4:00 p.m. and 5:15 p.m. in Room 282, City Hall. After taking testimony the Board voted 5-0 upon a motion by Commissioner Makras to recommend that the EIR required by the Superior Court have five alternative proposals in it and have a scope as described by the Environmental Review Officer in her letters to the Board dated May 8, 1991 and August 15, 1990. The five alternatives should cover: (1) a project with fewer units; (2) a project with less height; (3) a project with the existing 12-unit apartment house retained; (4) a project in complete compliance with the Planning and Building Codes; (5) a project retaining the number of affordable dwelling units presently existing on the site.
After completion of the EIR process the Board of Permit Appeals shall schedule a rehearing of Appeal Nos. 88-293/4/5. The Board shall rescind its vote of March 1, 1989 on the three matters at that time and shall adopt a new decision, this time after consideration of the EIR. The Superior Court shall retain jurisdiction for 60 days following the Board’s decision.
